As the real estate market continues to heat up here in Phoenix and the surrounding cities it's important to understand how a seller can provide the buyer a C.L.U.E. report easily without violating Federal and State laws.

Often, the real estate agent in the transaction will advise the seller to contact their insurance agent to get this report. Unfortunately, if the agent provides this report he/she will violate Federal and State laws and could face financial penalties and loss of insurance license.

For this post I'll just restate that the C.L.U.E. report is considered a "consumer report" just like a credit history report and needs to be handled in the same manner under Federal and State law. 

The Federal Fair Credit Reporting Act (FCRA)  and Arizona Statute Title Twenty - Chapter 11 "Insurance Information and Privacy Protection" regulates how personal information is handled by the insurance industry. These regulations are strictly enforced.

My recommendation for real estate agents is to create a simple document for your seller's directing them to the proper resource for obtaining their FREE CLUE Report. This website is https://personalreports.lexisnexis.com.  You can also go directly to the site by clicking on the picture.

The C.L.U.E. report provided will be a redacted version and will only contain Loss History and not personal information of the seller.

If you read my previous post linked above you'll discover that often times it is the buyer's past claim history that can have a negative impact on the purchase of a home. So, if you're working with a buyer it might be prudent to have a discussion early about this and encourage your buyer to begin securing insurance during the inpection period so there are no surprises.
